These Terms of Service (“Terms”) govern your access to and use of the website located at training.obsidianaz.com (the “Site”), operated by Obsidian Security LLC, dba Obsidian Security (“Obsidian,” “we,” “us,” or “our”). By accessing, purchasing from, or using the Site, you agree to be bound by these Terms.

If you do not agree to these Terms, do not access or use the Site.

1. Eligibility and Use of the Site

You must be at least eighteen (18) years old to use this Site or purchase training. By using the Site, you represent and warrant that you are legally capable of entering into a binding agreement.

You agree to use the Site and its content only for lawful purposes and in accordance with these Terms.

2. Nature of Services

The Site provides on-demand, digital training courses and related educational materials (“Courses”). All Courses are delivered electronically and are intended for informational and training purposes only.

Completion of any Course does not guarantee employment, certification, licensing, promotion, or legal compliance unless explicitly stated otherwise in writing.

3. Account Registration

To access certain Courses, you may be required to create an account. You agree to provide accurate, current, and complete information and to maintain the confidentiality of your login credentials.

You are responsible for all activity that occurs under your account.

4. Purchases, Pricing, and Payment

All prices are listed in U.S. dollars. Payment is due at the time of purchase. We reserve the right to change pricing or Course availability at any time without prior notice.

By submitting payment information, you represent that you are authorized to use the payment method provided.

5. Refund Policy (No Returns)

Because the Site sells digital, on-demand training, all sales are final once a Course has been completed or substantially accessed.

Limited Refund Eligibility

A refund may be requested within seven (7) calendar days of purchase only if:

  • The Course has not been completed, and

  • The Course has not been substantially accessed, as determined by our learning management system records.

Refund requests submitted after the 7-day window, or for completed or substantially accessed Courses, will not be approved.

6. Intellectual Property

All content on the Site, including Courses, videos, text, graphics, logos, trademarks, and materials, is the exclusive property of Obsidian or its licensors and is protected by intellectual property laws.

You are granted a limited, non-transferable, non-exclusive license to access and use purchased Courses for your personal, individual use only.
You may not:

  • Copy, reproduce, distribute, sell, sublicense, or share Course content

  • Record, download, or redistribute videos or materials

  • Allow third parties to access your account or purchased Courses

Unauthorized use may result in termination of access and legal action.

7. No Professional or Legal Advice

Course content is provided for educational purposes only and does not constitute legal advice, law enforcement authority, or professional certification unless explicitly stated.

You are solely responsible for complying with all applicable laws, licensing requirements, employer policies, and regulatory obligations.

8. Disclaimer of Warranties

The Site and all Courses are provided “as is” and “as available.”
We make no warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or accuracy.

We do not guarantee uninterrupted access, error-free operation, or that Course content will meet your specific requirements or expectations.

9. Limitation of Liability

To the fullest extent permitted by law, Obsidian shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of the Site or Courses.

In no event shall Obsidian’s total liability exceed the amount paid by you for the specific Course giving rise to the claim.

10. Indemnification

You agree to indemnify and hold harmless Obsidian, its owners, officers, employees, instructors, and affiliates from any claims, damages, losses, liabilities, or expenses arising from:

  • Your use of the Site or Courses

  • Your violation of these Terms

  • Your misuse of Course content

11. Termination

We reserve the right to suspend or terminate your access to the Site or Courses at our discretion, including for violations of these Terms, misuse of content, or fraudulent activity.

Termination does not entitle you to a refund unless required by law.

12. Governing Law and Venue

These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to conflict-of-law principles.

Any legal action arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in Arizona, and you consent to such jurisdiction.

13. Changes to These Terms

We may update these Terms from time to time. Changes will be effective upon posting to the Site. Your continued use of the Site constitutes acceptance of the updated Terms.
